The goods and services linked to this document are the goods and services that are displayed on our site at the time you access it. This includes all products listed as being out of stock. Any information, descriptions or images we provide about our goods and services are described and presented as accurately as possible. However, we are not legally bound by such information, descriptions or images as we cannot guarantee the accuracy of every product or service we provide. You agree to purchase these goods and services at your own risk.
Controls
Orders will only be recorded if the user is connected to the site as a member. Products are sold subject to availability. LA SOCIÉTÉ DES PLANTES INC. reserves the right, without further notice, to refuse to do business with any customer and/or to set a quantity limit for any item in an order. In the event of stock shortage or any other availability problem, LA SOCIÉTÉ DES PLANTES INC. undertakes to inform the user either at the time the order is placed, or as soon as possible by e-mail. Final validation of the order takes place once payment has been confirmed. Once an order has been placed, an e-mail will be sent to confirm its registration, with a summary of the items ordered and the delivery address.
Product availability
LA SOCIÉTÉ DES PLANTES INC. does not guarantee the availability of the products offered on the Site, but makes every effort to maintain up-to-date inventories. If LA SOCIÉTÉ DES PLANTES INC. is unable to deliver any of the products you have ordered due to stock shortage, you will be notified by phone/email and we will work out the best possible solution (replacement product, refund of the item or cancellation of the order). At no time will LA SOCIÉTÉ DES PLANTES INC. be liable for any damages you may suffer as a result of a stock shortage.
Price
All prices indicated on the site are in Canadian dollars, excluding taxes and shipping costs. LA SOCIÉTÉ DES PLANTES INC. reserves the right to modify the prices of products offered on the site at any time, without prior notice. This modification will not apply to orders placed.
The user will have to pay, in addition to the price of the products, a fixed contribution to the costs of sending and processing the order, the amount of which will be specified on the order form before the order is validated. For 2024, shipping costs via Poste standard base are 5.50$ for Canada. There are no shipping charges for orders to be picked up at our boutique at 207, rang de l'Embarras. When products require shipment via parcel post, additional charges are automatically applied, i.e. 18$ for parcel post, 19$ for trackable parcel post with tracking number sent by e-mail.

The following information is required: card number, expiry date and cardholder's name. For even greater security, the card's control number, i.e. the last 3 digits of the number on the back of the card, near the signature, will be required. Payment for purchases is made through GlobalPayments, a Desjardins partner. GlobalPayments guarantees the protection of all financial data transmitted.
By providing us with your payment details, you confirm that you have authorized us to use and access the payment instrument you have chosen to use. By providing us with your payment details, you confirm that you authorize us to charge the amount due to this payment instrument.
If we believe that your payment has violated a law or one of our terms of use, we reserve the right to cancel your transaction.
Services
Services will be invoiced in full when the service is ordered. You must read the conditions of sale, cancellation and refund policy on each service page. By purchasing a service, you accept the terms and conditions associated with it.
Transport and delivery
When you make a purchase on our site, you agree and acknowledge to provide a valid email and an accurate shipping address for the order.
LA SOCIÉTÉ DES PLANTES INC. will deliver the products ordered to the delivery address you provide when you place your order. The transmission of your order to the delivery service will be made as soon as possible after acceptance and full payment of your order, according to the delivery method determined at the time of purchase. Delivery times may vary according to destination, delivery method and product availability.
You will become the owner of the products you have ordered when they are handed over by LA SOCIÉTÉ DES PLANTES INC. to the shipping company. From that moment on, you will assume all risks and LA SOCIÉTÉ DES PLANTES INC. will not be responsible for their loss or destruction.
Although we aim to provide you with an accurate estimate of delivery times, these may vary due to unforeseen circumstances. We use the services of Canada Post for regular shipments and are therefore unable to guarantee delivery times. It is possible to select and pay for a package with a tracking number.
Orders including pre-sale fresh produce will be sent by regular mail for seeds, and by parcel post for bulbs, bulbils and rhizomes.
Delivery of products is subject to the rules of the delivery companies with which LA SOCIÉTÉ DES PLANTES INC. does business, as well as the rules of any other company with which it may do business from time to time. In particular, you are subject to the rules concerning the signing of an acknowledgement of receipt of products. If you are absent from the location where you have asked LA SOCIÉTÉ DES PLANTES INC. to deliver the products, it will be your responsibility to pick up the products according to the rules of the delivery company chosen. LA SOCIÉTÉ DES PLANTES INC. must have received full payment for the products to be delivered to you before proceeding with delivery. We reserve the right to modify, reject or cancel your order whenever necessary. If we cancel your order and have already processed your payment, we will give you a refund equivalent to the amount you have paid. You agree that it is your responsibility to monitor your payment method.
Warranties
Satisfaction
We invite you to contact us directly if you are not satisfied with the product(s) you have received.
The customer has 15 days after purchase to obtain a refund or exchange of a product ordered from LA SOCIÉTÉ DES PLANTES INC. This must be done in writing (e-mail) and the terms of the refund or exchange will be determined between LA SOCIÉTÉ DES PLANTES INC. and the customer. The customer must specify his or her name, complete contact information, order number and the reason for the return or exchange. In the event of a return due to quality damage or manufacturing problems, LA SOCIÉTÉ DES PLANTES INC. will pay the shipping costs. Items returned opened, spoiled or damaged by the customer will not be accepted for return. LA SOCIÉTÉ DES PLANTES INC. will not refund or exchange any product that has been opened by the customer. The reimbursement of the price of the products will be made within 30 days of the establishment of the terms and conditions between the customer and LA SOCIÉTÉ DES PLANTES INC. In the event of abusive returns, LA SOCIÉTÉ DES PLANTES INC. reserves the right to refuse a subsequent order by this customer.
Limitation of liability
LA SOCIÉTÉ DES PLANTES INC. or any of its employees will be held responsible for any problems arising from this site. However, LA SOCIÉTÉ DES PLANTES INC. and its employees will not be held responsible for any problems arising from improper use of this site.
In the event that LA SOCIÉTÉ DES PLANTES INC. is found to be liable to you, its liability shall be limited to an amount of money equivalent to the price you paid for the returned products. Notwithstanding the foregoing, nothing in this section shall have the effect of limiting any rights you may have as a consumer under any public law that may be applicable to you.
Compensation
As a user, you hereby indemnify LA SOCIÉTÉ DES PLANTES INC. from and against any and all liability, costs, causes of action, damages or expenses arising out of your use of this site or your breach of any of the provisions set forth herein.
Applicable laws
This document is subject to the applicable laws of Canada and is intended to comply with its necessary rules and regulations. For EU residents, the RGPD is the applicable law governing this document. In the event of any inconsistency between a provision of this document and the RGPD, the rules of the RGPD shall prevail.
Applicable law
In the event of a dispute, an amicable solution will be sought before any legal recourse. Any dispute relating to the LA SOCIÉTÉ DES PLANTES INC. site shall be governed by the laws in force in the province of Quebec and shall be submitted to the competent courts of the province of Quebec. If any provision of these Terms of Use is found by a court of competent jurisdiction to be invalid, such invalidity shall not affect the validity of the remaining provisions. The invalid provision shall be severed from the remaining provisions of these Terms of Use, which shall remain in full force and effect.
Divisibility
If, at any time, any of the provisions set forth herein are found to be inconsistent with or invalid under applicable law, such provisions shall be deemed null and void and shall be removed from this document.
